Terms and Conditions

Parr Excellence Business Limited supplies goods and services to The Purchaser subject to the following terms and conditions.  The Purchaser agrees to these Terms and Conditions and confirms they will strictly comply with them.  The Purchaser should be aware that it is Parr Excellence Business Limited’s intention that all terms of the contract between them and The Purchaser are contained in this document.  Please read them carefully.  If there is anything The Purchaser does not understand or does not agree with, please ask.

General

1. These Terms and Conditions apply to all customers on- and off-line.

2.  Parr Excellence Business Limited does business only under these Terms and Conditions.

3. Goods and services are subject to availability and may vary from those advertised.

4.  The Purchaser must decide before ordering if the goods and services are suitable for his/her needs.

5.  Parr Excellence Business Limited is not obliged to accept The Purchaser’s order or offer The Purchaser credit terms.  No contract is made with The Purchaser until payment is made.

Provisional Bookings

6.  Parr Excellence Business Limited welcomes provisional bookings and will hold them until no later than 21 working days prior to the course start date.  The Purchaser is advised to confirm his/her booking in writing with payment in advance of that date to guarantee his/her place on the course.

Prices

7.  The prices quoted are correct at the date of publication.  Parr Excellence Business Limited reserves the right to adjust these prices in order to meet their true cost.

8.  Parr Excellence Business Limited’s advertised prices do not include VAT and delivery unless otherwise indicated.  The price of the goods may be changed from that advertised.  It is The Purchaser’s responsibility to confirm the price before ordering.

Payment

9. Course fees must be paid in full 21 days in advance of the course.  Parr Excellence Business Limited reserves the right to re-allocate the course place to another delegate if fees are not paid on time.  Delegates will not be admitted to a course if payment in full has not been received.

10. A 50% deposit is payable on booking consultancy services, with the balance due on the day of the appointment or sooner.

11.  All other goods and services must be paid for before delivery except where agreed otherwise in writing by both parties.

12.  Parr Excellence Business Limited accepts payment by bank transfer, credit card, cheque or cash.

13.  Goods and services bought on credit (a corporate 30 day invoice) must be paid for within 30 days from Parr Excellence Business Limited’s invoice date or before commencement of the course, whichever is the sooner.  Parr Excellence Business Limited reserves the right to take up references before supplying goods and services on credit and may refuse credit without further explanation.  Parr Excellence Business Limited may share customer credit history information with relevant credit agencies.

14.  Parr Excellence Business Limited remains the owner of the goods purchased until The Purchaser has paid for them in full.  Parr Excellence Business Limited may retrieve and resell the goods if they are not paid for.  This applies to all goods Parr Excellence Business Limited supplies to The Purchaser and to any money owing in respect of any transaction with The Purchaser.

15.  Under the Late Payment of Commercial Debts Regulations 2002, Parr Excellence Business Limited may exercise its statutory right to charge interest and an administration charge on all overdue invoices.

Discounts and special offers

16.  Any discounts offered on Parr Excellence Business Limited courses are exclusive.  They cannot be combined.  Except for company-wide or pre-agreed discounts, the higher discount will always be applied.  In the case of special offers these must be requested at time of booking and will not automatically be applied.

Transferring courses

17.  If a delegate wishes to transfer a booking to a later course there will be an administrative charge of 25% of the course fee if it is within 21-15 working days of the original courses date.  If a delegate wishes to transfer a booking to a later course and the original course date is within 14 working days there will be a charge of 40% of the course fee.  If that transfer is then cancelled and/or the delegate fails to attend, the full course fee remains payable.  If a second transfer is requested this will be treated as a cancellation and the cancellation fee will be liable in addition to the new course fee.

Cancelling attendance

18.  All cancellations to course bookings must be made at least 21 working days prior to the start of a course.  If the course is cancelled between 20-15 working days a cancellation fee of 50% will be payable.  If a booking is cancelled within 14-1 days of the course start date or if the delegate fails to attend the course, the full course fee is forfeited or must be paid immediately if it is on a corporate 30 day invoice.

19.  Parr Excellence Business Limited retains the 50% deposit for consultancy appointments that are not kept when no notice has been given. If 5 days' notice is given, the charge is reduced to 25%. Where more than 5 days' notice is given, there is no charge.

Changing delegate details

20.  There will be no charge if a substitute person wishes to replace the original delegate.  Please inform Parr Excellence Business Limited of any change to the original booking.

Cancellation of courses by Parr Excellence Business Limited, changes to course content and published information

21.  Parr Excellence Business Limited reserves the right to cancel a course at any time without liability.  In these circumstances, at the discretion of Parr Excellence Business Limited, delegates may be offered an alternative date, a credit note or a full refund.  Parr Excellence Business Limited’s courses are constantly updated and improved and Parr Excellence Business Limited reserves the right to alter and make reasonable variations to any of the courses’ content without prior notice and to change the price thereof.  The contents of the Parr Excellence Business Limited’s Brochure/Calendar/Website are intended for general guidance and do not form part of any contract.

Course notes and training 

22.  The notes and training for Parr Excellence Business Limited courses cannot be relied upon for legal interpretation.  Neither Parr Excellence Business Limited nor its employees, trainers or consultants can accept responsibility for delegates’ actions, or those of other people reading the course notes or interpreting the training in litigation, or responsibility for any loss incurred as a result of relying on the training or the training notes.  If in doubt, the Purchaser should consult a lawyer.

Copyright

23.  The copyright of all courses, books and publications produced by Parr Excellence Business Limited is owned by Parr Excellence Business Limited, except where otherwise attributed.  Any copying or reproduction of the materials without the express written permission of the copyright holder may result in legal action .

Guarantee and Liability

24.  The Purchaser benefits from Parr Excellence Business Limited’s warranty in respect of all goods Parr Excellence Business Limited sells.

25.  Parr Excellence Business Limited is liable for death or personal injury caused by Parr Excellence Business Limited’s negligence.  To the extent allowed by law Parr Excellence Business Limited expressly disclaims any liability for indirect or consequential loss suffered by The Purchaser.

Promotions

26.  Parr Excellence Business Limited sometimes offers promotions.  It is The Purchaser’s responsibility to notify Parr Excellence Business Limited if he/she does not want to receive details of these promotions.

Data Protection

27.  The Purchaser consents to computer storage and processing of their personal/company data by Parr Excellence Business Limited in connection with their purchase for the purposes of Parr Excellence Business Limited’s legitimate interests, including statistical analysis, marketing and credit control.  If The Purchaser breaches these Terms and Conditions their personal/company data may be disclosed or passed to third parties to the extent necessary to assist recovery procedures.  Parr Excellence Business Limited is registered with the Data Protection Registrar.

Telephone Calls

28.  Parr Excellence Business Limited may monitor or record telephone calls for training purposes.

Law & Jurisdiction

29.  Parr Excellence Business Limited aims to resolve all disputes amicably.  If this is not possible, the law of England and Wales will apply and its courts will have jurisdiction

30.  Parr Excellence Business Limited is a limited company whose registered office is at Windsor Lodge, Purley Rise, PURLEY, Surrey, CR8 3AW, registered in England and Wales, number 6286721.  Parr Excellence Business Limited is also registered for VAT, registration number GB 916 3142 44 and charges VAT at the relevant rate on all invoices.
